Collecting and Using Your Personal Data

Types of Data Collected

The personal data of users collected and used by Topaz in particular, are as follows: your order information if you make a purchase through in-app purchase, the photos which you upload to our app and identifier for advertisers designated in your mobile device used in accessing our services (The Identifier for Advertisers-IDFA), identifier for vendors/developers designated your mobile device (The Identifier for Vendors-IDVF) and Internet Protocol Address-IP Address.

Our App allows you to modify selected photos, which you can source from your device’s camera, camera roll, provided you’ve granted the necessary permissions. We want to emphasize that our processing is limited exclusively to the specific visual content you actively choose to edit using our App. While you may grant us access to your entire photo or video library, we don’t collect or store this data comprehensively. Our focus remains solely on the individual images you deliberately select for modification within our App, ensuring your privacy and control over your visual content.

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

  • Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

Information Collected while Using the Application

While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:

  • Pictures from your Device’s camera and photo library

We use this information to provide features of Our Service, to improve and customize Our Service. The information may be uploaded to the Company’s servers and/or a Service Provider’s server or it may be simply stored on Your device.

You can enable or disable access to this information at any time, through Your Device settings.

Use of Your Personal Data

We use the images you upload to our App solely for the purpose of providing you with our editing services. These images are not used for any other purposes beyond enabling the App’s editing functionality.

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including to monitor the usage of our Service.

  • To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.

  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.

    Special Conditions on Processing of Face Data

    This section contains specific information about what kind of data is collected, used, shared, and retained when users upload a photo that contains face from Photo Library or by using Camera.

    Collection and Use of Face Data

    Upon uploading a photo containing facial features to our application, our app collects both the complete facial imagery and its corresponding mathematical representation. The collected facial data is used exclusively for the purpose of applying visual filters to the user’s facial image through our AI. This AI processing occurs solely on our own servers, without reliance on any third-party services.

    Storage and Retention of Face Data

    The information will be securely stored on our servers, specifically using Supabase Storage. By default, if a user has not utilized the app for a period of one month, all their data will be permanently deleted. This includes the removal of any stored data and the deletion of the user’s membership (Anonymous Login).

    Third-Party Data Sharing

    Our organization maintains a strict policy of data confidentiality. We do not engage in any sharing, selling, or transferring of user data, including facial information, to third parties. All data collected and processed remains solely within our secure, proprietary systems and is used exclusively for the purposes explicitly stated in our privacy policy.

    Your Choices

    Managing Your Notification and Device Settings

    Push Notifications: You have control over the push notifications you receive from us. To stop receiving these notifications, you can adjust the settings on your mobile device.

    Device Permissions: We respect your right to control access to your device features. You can withdraw any permissions you’ve previously given us, such as access to your:

  • Camera
  • Camera roll

    To modify these permissions, simply access your mobile device’s settings and make the desired changes.

    Delete Your Personal Data

    You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.

    Our Service may give You the ability to delete certain information about You from within the Service.

    You may update, amend, or delete Your information at any time by signing in to Your Account, if you have one, and visiting the account settings section that allows you to manage Your personal information. You may also contact Us to request access to, correct, or delete any personal information that You have provided to Us.

    Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so.
